Terms of Service

Please read these Terms of Service ("Terms") carefully. By accessing or using Moment, you agree to be bound by these Terms and our Privacy Policy.
1. Eligibility & Account
You must be at least 18 years old to use Moment. To create an account you provide an email and password (via AWS Cognito) or sign in with a phone number. To host a Moment or join someone else’s Moment, you must verify your phone number via a one-time SMS code. Browsing the public feed does not require verification.
2. Safety & Interactions
YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS WITH OTHER USERS.
Moment verifies that users control the phone number they sign in with. We do not conduct criminal background checks, sex offender registry screenings, or identity verification. We do not verify the accuracy of statements, photos, or biographical content provided by users.
WE MAKE NO REPRESENTATIONS OR WARRANTIES AS TO THE CONDUCT OF USERS OR THEIR COMPATIBILITY WITH ANY CURRENT OR FUTURE USERS.
Moment reserves the right to conduct background checks but has no obligation to do so.
3. Prohibited Conduct
You agree NOT to:
- Use the service for any purpose that is illegal or prohibited by these Terms.
- Harass, intimidate, stalk, or defame any person.
- Post content that is hate speech, threatening, sexually explicit, or pornographic.
- Impersonate others or use photos that are not of you.
- No-show, repeatedly cancel, or otherwise abuse hosts’ or guests’ time.
- Use Moment for solicitation, prostitution, or selling drugs.
4. Reviews & User Content
You may rate hosts after attending a Moment (1–5 stars plus optional written review). Reviews are public to other users and counted toward the host’s aggregate rating. By submitting a review you grant Moment a non-exclusive, royalty-free, worldwide license to host, display, and distribute it. You are responsible for the truthfulness of your reviews; reviews must reflect a genuine attended Moment.
5. Subscriptions & Virtual Items
Pro Subscription. The Moment Pro subscription is available via the Apple App Store (in-app purchase on iOS) or via Stripe (when subscribing on the web). It renews automatically until cancelled.
- iOS subscribers manage and cancel via iPhone Settings → Apple ID → Subscriptions. Refunds are governed by Apple’s policies.
- Web subscribers manage and cancel via the Store page on jointhemoment.app, which opens a Stripe billing portal. Refunds are at our discretion, except where required by law.
Boosts and Golden Tickets. You may purchase consumable items such as Boosts (extra visibility) and Golden Tickets (priority application). These are a limited, personal, non-transferable, non-sublicensable, revocable license to access in-app features. They have NO real-world monetary value. You do not own them. We may change their cost or utility at any time.
All purchases are final and non-refundable, except where required by law or Apple’s App Store policies (for App Store purchases).
6. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MOMENT OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS.
8. Dispute Resolution (Arbitration)
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS.
You agree that any dispute or claim relating in any way to your use of Moment will be resolved by binding arbitration, rather than in court. You waive any right to a jury trial or to participate in a class action lawsuit.
9. Governing Law
These Terms shall be governed by the laws of the State of Washington, without respect to its conflict of laws principles.
Nothing in these Terms waives any non-waivable rights you have under the consumer protection laws of your state of residence.
